1. Acceptance of Terms

By accessing or using the website located at www.grounduprehab.com (the “Site”), you agree to be bound by these Terms of Service (the “Terms”). Ground Up Rehab, PLLC may amend these Terms from time to time. If you do not agree with any part of the Terms, you must not use the Site. 

2. Medical Disclaimer

Information on the Site is for educational purposes only and does not constitute medical advice, diagnosis, or treatment. Always consult a qualified health‑care provider regarding any medical condition. Use of the Site—including viewing content, submitting contact or inquiry forms, or scheduling requests—does not create a provider–patient relationship with Ground Up Rehab, PLLC (“GUR,” “we,” “our,” or “us”).

3. Use of the Site
  • You agree to use the Site only for lawful purposes and in accordance with these Terms.
  • You must not attempt to gain unauthorized access to the Site, its servers, or any data.
  • You must be at least 18 years old or the legal age of majority in your jurisdiction to use interactive features (e.g., appointment requests, contact forms, messaging features).
4. Appointment Scheduling & Payments

If the Site offers online scheduling or bill‑pay links, you understand that: 1. Insurance benefits quoted are estimates only. 2. You are financially responsible for all services rendered, including co‑pays, deductibles, and any non‑covered services. 3. Payments processed through third‑party platforms are subject to those platforms’ separate terms and fees.

5. Intellectual Property

All content on the Site—including text, graphics, logos, photos, videos, and software—is the property of Ground Up Rehab, PLLC or its licensors and is protected by U.S. and international copyright and trademark laws. No content may be reproduced, distributed, or modified without our prior written consent. The Site may contain content that is provided under license from third parties. Such content is licensed and maintained exclusively by third parties. Ground Up Rehab, PLLC provides you with access to such content solely for your education and makes no representation or warranty regarding the accuracy of such content. You agree to hold Ground Up Rehab, PLLC and third-party licensors of such content harmless from any claims or harm that may result from your access to this copyrighted material.

 If you have any copyright concerns about materials posted on the Site, you agree to let

Ground Up Rehab, PLLC know. Pursuant to Title 17, United States Code, Section 512(C)(2), notifications of claimed copyright infringement should be sent to Ground Up Rehab, PLLC’s Designated Agent. An effective notification contains the following:

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online Site are covered by a single notification, a representative list of such works at that Site.

Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.

Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

6. Privacy & HIPAA Compliance

The Site itself does not collect or store Protected Health Information (“PHI”). Any PHI—including health history, diagnoses, or insurance details—must be submitted exclusively through our HIPAA‑secure PracticeQ, WebPT/Therabill or other patient‑portal link. That portal is covered by a Business Associate Agreement (BAA) and by our separate Notice of Privacy Practices (NPP). With respect to Personal Health Information ("PHI") submitted via intake forms or patient portals, we comply with the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and the Illinois Personal Information Protection Act (815 ILCS 530), which sets state‑level breach‑notification and data‑protection requirements.

7. Links to Third‑Party Sites

The Site may contain links to Sites operated by other parties. The Ground Up Rehab, PLLC does not sponsor, operate, control, or endorse any of these sites, nor the information, products, or services provided by third parties through the Internet, nor does the Ground Up Rehab, PLLC make any guarantee, warranty, or representation regarding the accuracy of the information contained on the Sites. The Ground Up Rehab, PLLC has no control over the security or privacy practices of these external Sites. Use of other sites is strictly at your own risk including, but not limited to, any risks associated with destructive viruses. You are responsible for viewing and abiding by the terms and conditions of use and privacy statements of the other Sites.

8. No Warranties

This site is provided by us on an “as is” and “as available” basis, and without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. GUR does not warrant the accuracy or completeness of any information contained on the site and is not responsible for any errors or omissions or for the results obtained from the use of such information. We do not warrant that the site is secure or free from viruses or other harmful components. The information contained on the site is not confidential and does not establish a treatment relationship. To the maximum extent permitted by applicable law, under no circumstances shall GUR be liable for any direct, indirect, punitive, exemplary, incidental, special, or consequential damages, fees, fines, penalties, loss of revenue or business or liabilities in connection with the use of, or inability to use the site and/or content or information provided on or through the site. By using or accessing the site, you acknowledge and agree that your sole and exclusive remedy for dissatisfaction with the site is to stop using the site. If the foregoing limitations are disallowed, in any event, the total liability for GUR shall be $5.00 USD.

9. Data Retention

We retain Personal Identifiable Information (PII) and Personal Health Information (PHI) only as long as necessary to fulfill the purposes described in this Policy and to comply with legal and professional obligations.

  • Electronic intake forms & clinical documentation—including exercise‑tracking data—are stored in PracticeQ EMR and/or WebPT/Therabill EMR and backed up in Dropbox and/or Microsoft Cloud, all configured in HIPAA‑compliant mode with executed Business Associate Agreements (BAAs).
  • Adult patient records are kept at least seven (7) years from the last date of service, in accordance to applicable laws.
  • Records for minors are maintained until the patient reaches age 23 or seven (7) years from the last date of service—whichever period is longer (per 68 Ill. Admin. Code 1350.90).
  • Non‑clinical web‑contact data (e.g., general inquiries, newsletter sign‑ups) are purged after 24 months of inactivity.

All backups are encrypted at rest and destroyed following the same retention schedule.

10. Your Rights Indemnification

You agree to indemnify and hold harmless Ground Up Rehab, PLLC, its owners, employees, and agents from any claim or demand arising out of your use of the Site or violation of these Terms.

11. Compliance

By accessing this Site, you agree and consent that your use of the Site any services or materials are subject to your agreement with these Terms and Privacy Policy. You agree that you will not violate any local, state, federal or international laws in using the Site or accessing any material on this Site. Ground Up Rehab, PLLC reserves the right to prohibit, restrict, or discontinue your access to certain pages within the Site, if you violate any of the Terms. Ground Up Rehab, PLLC also reserves the right to temporarily or permanently discontinue this site, any page, or any functionality on this Site at any time and without notice. Ground Up Rehab, PLLC may modify these Terms at any time without notice. Furthermore, Ground Up Rehab, PLLC reserves the right to report violations of law to appropriate law enforcement agencies and to pursue all other rights and remedies available to it under civil or criminal law. 

12. Social Media Participation & User Content Policy

Ground Up Rehab, PLLC may maintain an active presence on various social media platforms, including but not limited to Facebook, Instagram, LinkedIn, YouTube, and other emerging platforms. These channels are used to share educational content, engage with the public, and promote wellness initiatives. Please note that our list of active platforms may change without prior notice.

By interacting with Ground Up Rehab, PLLC through any of these social media platforms, you acknowledge and accept that your activity may be visible to the public and is subject to monitoring. We reserve the right to moderate, remove, or restrict content or user activity at our sole discretion—particularly if it is deemed inappropriate, offensive, misleading, or in violation of applicable laws or platform standards.

  • Participation on social media is voluntary and may result in the disclosure of personally identifiable information. Please use caution when commenting or posting. Once something is shared, it may be publicly visible and potentially unretractable.

Prohibited Conduct: When posting on or engaging with Ground Up Rehab, PLLC’s social media, you agree not to:

  • Impersonate others or misrepresent your identity.
  • Post defamatory, threatening, unlawful, obscene, abusive, harassing, or otherwise disruptive content.
  • Engage in personal attacks, spam, advertising, or promotion of illegal activities.

Ground Up Rehab, PLLC may, at any time and without notice, restrict or terminate access to its social media channels, and reserves the right to edit or remove any content shared on its pages for any reason.

User-Generated Content & License to Use: By posting content (e.g., comments, images, or messages) on our social media, you grant Ground Up Rehab, PLLC a non-exclusive, royalty-free, global license to reuse, republish, or modify that content for educational, promotional, or informational purposes. You also understand that we cannot control how other users, or third parties may interact with or redistribute such posts.

The views expressed by individuals on our social platforms do not necessarily reflect the views of Ground Up Rehab, PLLC or its providers.

By using our Site or engaging with our social media channels implies your acceptance of this Social Media Policy, our full Privacy Policy, and our Terms of Use. Continued access constitutes agreement to any updates or changes made to these policies.

13. Changes to This Policy

We may revise these Terms at any time by posting the updated version on the Site. Your continued use after changes are posted constitutes acceptance of the revised Terms.
